Terms and Conditions
1.Definitions
“Company”refers to Defcon Films Australia (DFA).
“Customer”refers to any individual or business that purchases,orders,or uses DFA products or services.
“Products”refers to any paint protection film (PPF),automotive window tint film, tools,accessories,or related products supplied by DFA.
“Agreement”refers to these Terms and Conditions.
2.Orders and Acceptance
All orders are subject to confirmation and acceptance by the Company.
The Company reserves the right to reject any order due to stock availability, pricing errors,or other reasonable causes.
Upon acceptance of an order,the Customer is deemed to have agreed to and be bound by these Terms and Conditions.
3.Pricing and Payment
All prices are quoted in Australian Dollars (AUD) and exclude GST,unless otherwise stated.
Full payment must be received prior to dispatch,unless a credit account has been approved in writing by the Company.
The Company reserves the right to adjust pricing at any time without prior notice.
4.Delivery and Risk
Delivery charges are the responsibility of the Customer unless otherwise agreed in writing.
Risk in the Products passes to the Customer upon delivery to the Customer or to the carrier,whichever occurs first.
Delivery dates are estimates only;the Company shall not be liable for any delays in delivery under any circumstances.
5.Returns and Refunds
All sales are final unless the Product is proven to have a manufacturing defect.
Where a manufacturing defect is confirmed,the Company may,at its discretion:
Provide a replacement product.
Returned Products must be in original,unused condition and in undamaged packaging to qualify for return consideration.
Returns will not be accepted without prior written approval from the Company.
6.Limitation of Liability
The Company’s total liability for any claim arising out of the supply or use of Products shall not exceed the purchase price of the specific Product giving rise to the claim.
The Company shall not,under any circumstances,be liable for any indirect, incidental,consequential,or special loss,including but not limited to loss of profits,revenue,or business opportunities.
The Customer acknowledges that the use of DFA Products is at their own risk and that performance may vary depending on environmental and installation conditions.
7.Intellectual Property
All trademarks,brand names,packaging designs,product literature,installation guides,and marketing materials are the sole property of Defcon Films Australia.
No Customer or third party is permitted to reproduce,modify,or distribute any such materials without prior written consent from the Company.
8.Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia.
The parties submit to the exclusive jurisdiction of the courts of Melbourne, Victoria for any dispute arising under or in connection with this Agreement.
9.Amendments
The Company reserves the right to amend or update these Terms and Conditions at any time without prior notice.
The most recent version will be made available on the Company’s official website and shall supersede any previous versions.
10.Acknowledgment
By placing an order with Defcon Films Australia,the Customer acknowledges that they have read,understood,and agreed to these Terms and Conditions in full.
11.Resale Restriction
The Customer is strictly prohibited from reselling,redistributing,or supplying DFA Products to any third party without the Company’s prior written authorisation.
Any unauthorised resale,redistribution,or transfer of DFA Products will result in the immediate termination of all warranties and technical support associated with the Products,and may lead to suspension of future supply or legal action.
